REFUND POLICY & TERMS and CONDITIONS

TERMS AND CONDITIONS OF SERVICE - VIA VAN LLC
 

1. COMPANY INFORMATION AND LEGAL STATUS
 

VIA VAN LLC is a Florida limited liability company providing prearranged private passenger transportation services in accordance with Florida Statutes, local regulations, and FMCSA/DOT requirements. The Company is the direct provider of transportation services and is not a digital marketplace or intermediary platform.
 

2. NATURE OF SERVICE
 

Transportation is private, prearranged, and non-public. All trips require advance reservation. Routes, schedules, and stops are predetermined. Estimated times are not guaranteed, as they are subject to operational and traffic conditions.
 

3. TICKET POLICY, CHANGES, AND VALIDITY
 

  • Ticket Nature: Tickets are personal, non-transferable, and issued in digital format only. The digital ticket constitutes the sole valid proof of travel.

  • Verification: Passengers are responsible for verifying the date, time, and route at the time of purchase.

  • Changes and Postponements: Changes are permitted up to 3 hours before scheduled departure, subject to seat availability and a $10 USD penalty per ticket.

  • Validity: Rescheduled tickets are valid for up to 30 days from the original travel date.
     

4. NO-REFUND POLICY & NO-SHOWS
 

  • Final Sales: All sales are final. No refunds will be issued for any reason, including change of plans, errors in booking, or external factors.

  • No-Show: Failure to appear at the scheduled departure time results in total forfeiture of the ticket.

  • Courtesy Exchange: At the sole discretion of VIA VAN LLC and subject to availability, a same-day, same-route exchange may be allowed with a $10 USD penalty. The passenger must notify VIA VAN LLC immediately via WhatsApp.
     

5. FARES, MINORS, AND CHILD SEATS
 

  • Standard Fare: All passengers, including children, pay the full fare as they occupy an individual seat.

  • Minors: Passengers under 18 years of age must be accompanied by a responsible adult.

  • Child Seats: Child safety seats are not provided unless expressly agreed in advance.
     

6. LUGGAGE POLICY AND LIABILITY
 

  • Permitted Luggage: 1 suitcase in the trunk (max 35 lbs) and 1 small carry-on item in the cabin (max 10 lbs).

  • Prohibited Items: Pets of any kind, cardboard boxes, laundry bags, plastic containers, weapons, and hazardous or illegal substances.

  • Liability: VIA VAN LLC is not responsible for valuables or items left in the vehicle. Maximum liability for properly stored luggage is $25 USD per item.
     

7. SCHEDULES AND PUNCTUALITY
 

Passengers must be at the designated stop at least 5 minutes prior to departure. VIA VAN LLC is not liable for delays due to traffic, weather, mechanical issues, or missed connections (flights, appointments, etc.).
 

8. PASSENGER CONDUCT AND SEAT BELTS
 

  • Behavior: Smoking or vaping is strictly prohibited. VIA VAN LLC reserves the right to refuse service without refund to passengers under the influence of alcohol/drugs or those exhibiting aggressive or unsafe behavior.

  • Seat Belts: The vehicle is equipped with safety belts, and their use is mandatory for all passengers at all times while the vehicle is in motion. Viavan and the driver shall not be held liable for any injury or loss resulting from a passenger's failure to wear a seat belt. The passenger assumes full responsibility for any legal fines imposed by authorities due to non-compliance.
     

9. PARKING AND INDEPENDENCE DISCLAIMER
 

  • Independence: VIA VAN LLC is an independent entity and has no affiliation with the City of Weston or the Weston Commercial Center.

  • Parking: Passengers are solely responsible for their own parking. VIA VAN LLC is not responsible for fines, towing, damage, or theft of vehicles parked near pickup locations.
     

10. INSURANCE AND LIMITATION OF LIABILITY
 

In the event of an accident or injury, the Company’s liability is strictly limited to the maximum coverage limits of its active commercial auto liability insurance policy. No personal or corporate assets beyond said policy limits shall be exposed. The Company is not liable for damages caused by third parties or passenger negligence.
 

11. FORCE MAJEURE (UNFORESEEABLE EVENTS)
 

VIA VAN LLC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause that is beyond the reasonable control of the Company, including but not limited to: extreme weather conditions, hurricanes, floods, government-mandated closures, road closures, strikes, or civil unrest.
 

12. PARTIAL WAIVER AND ASSUMPTION OF RISK
 

By using the service, the Passenger voluntarily assumes the inherent risks of vehicular transportation and agrees to waive claims against VIA VAN LLC, except in cases of gross negligence or willful misconduct as defined by Florida law.
 

13. GOVERNING LAW AND VENUE
 

This Agreement shall be governed by the laws of the State of Florida. Any dispute arising from these terms or the services provided shall be resolved exclusively in the courts of Broward County, Florida.
 

14. ACCEPTANCE OF TERMS
 

The purchase of a ticket, payment for service, or boarding the vehicle constitutes full and irrevocable acceptance of these Terms and Conditions by the passenger.
